By accessing or using the Poolify AI website at getpoolifyai.com, or by subscribing to our services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and Poolify AI Ltd, located at Wexford, Ireland, Y21 K122 ("Poolify AI," "we," "our," or "us").

Poolify AI provides an AI-powered receptionist service for pool service businesses. Our services include:

• 24/7 AI voice receptionist for answering inbound calls
• Customer lead capture and forwarding
• Appointment booking assistance
• Missed call text-back automation
• SMS lead reactivation campaigns
• Automated Google review request messages
• Onboarding and setup support

The specific features available to you will depend on your subscription plan. We reserve the right to modify, update, or discontinue any feature of our service at any time with reasonable notice.

Monthly subscription: Poolify AI is offered on a monthly subscription basis. Your subscription will automatically renew each month unless you cancel before your renewal date.

Pricing: Current pricing is $197 per month, plus a one-time setup fee of $150. Pricing is subject to change. We will provide at least 30 days' notice before any price increase takes effect for existing customers.

Early adopter pricing: Early adopter pricing is available to the first 10 qualifying pool service businesses. This pricing is not guaranteed to remain available and may be updated at our discretion.

Payments: Payment is due at the start of each billing period. We use secure third-party payment processors. By providing your payment information, you authorize us to charge the applicable fees to your payment method.

Refunds: We do not offer refunds for monthly subscription fees already charged. The one-time setup fee is non-refundable once onboarding has commenced.

You may cancel your subscription at any time by contacting us at poolifyaisaas@gmail.com. Upon cancellation, your service will remain active until the end of your current billing period, after which it will not renew. No partial refunds will be issued for unused time within a billing period.

You agree not to use our services to:

• Violate any applicable law or regulation
• Engage in deceptive, fraudulent, or misleading practices
• Harass, abuse, or harm any individual
• Send unsolicited spam or communications
• Interfere with or disrupt the integrity or performance of our services
• Attempt to gain unauthorized access to our systems or data

We reserve the right to suspend or terminate your account if we determine you are in violation of these acceptable use terms.

Poolify AI uses artificial intelligence technology to handle inbound calls. While we work to ensure a high-quality experience, we cannot guarantee:

• That the AI will handle every call scenario perfectly
• 100% uptime or availability of the service
• That all customer inquiries will be captured without error
• Specific outcomes such as bookings, revenue, or lead volume

You acknowledge that AI systems may make errors, and you agree to use your own judgment when following up on leads and information captured by the AI receptionist.

To the fullest extent permitted by applicable law, Poolify AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or customers, arising out of or related to your use of our services.

Our total cumulative liability to you for any claims arising from or related to these Terms or our services shall not exceed the total fees paid by you to Poolify AI in the three months preceding the event giving rise to the claim.

All intellectual property rights in the Poolify AI platform, including but not limited to the software, AI models, branding, website design, and content, are owned by or licensed to Poolify AI Ltd. You are granted a limited, non-exclusive, non-transferable license to use the services for your own business purposes during the term of your subscription.

You may not copy, modify, distribute, sell, or sublicense any part of our service or its underlying technology without our prior written consent.

Both parties may have access to confidential information of the other party in connection with the services. Each party agrees to protect such confidential information with the same degree of care it uses to protect its own confidential information, and not to disclose such information to any third party without prior written consent.

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your data as described in the Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising from or related to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Ireland.

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
